SUITED & BOOTED dba NICESEATS (“NICESEATS” or “we” or “us”) has created this privacy policy (this "Privacy Policy") in order to demonstrate its commitment to users and user privacy with regard to NICESEATS website located at www.niceseats.com (“the Site”). Privacy on the Site is of great importance to us.  Because we gather important information from our users and visitors (collectively “Users” or “you” or “your”), we have established this Privacy Policy to communicate our information gathering and dissemination practices. In addition to the use of information described above, NICESEATS reserves the right to disclose information provided by Users (including Personal Information) as follows:

Disclosure By Law.  You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); or (2) protect or defend NICESEATS’S, or a third party’s, rights or property. 

 

Transfer to Third Party Service Providers. We may share your information with third party service providers to perform functions on our behalf.  Examples include but are not limited to fulfilling orders, processing payments, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service. NICESEATS may also partner with third party service providers for fraud prevention and/or identity verification. Your information will be treated as private and confidential by such third party service providers and not used for any other purpose than we authorize. Some of our service providers may be located in a country different from yours, in which case your personal information may be transferred to, and be subject to the laws of, that jurisdiction.

 

Data/Information Transfer As a Result of Sale of Business. In the event that NICESEATS is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, NICESEATS reserves the right to sell or transfer User information (including Personal Information) as part of any such transaction.  To the maximum extent allowable by law, the Privacy Policy will apply to the User information as transferred to the successor entity. However, User information submitted after a transfer to a successor entity may be subject to a new privacy policy adopted by the successor entity.

 

Data Retention

NICESEATS securely stores your data on Shopify’s servers.  Shopify and we keep your information, such as your name, email address and phone number for as long as you keep your account in existence.  In some instances, we will delete the information you provide to us after it is no longer needed. We also keep information about you and your use of the Site for long as it is necessary for our legitimate business interests, for legal reasons, and to prevent harm to you, any third party, or us.

 

Your Data Protection Rights

For User data that is subject to GDPR, and in other applicable jurisdictions, Users are entitled to various data protection rights as outlined as follow:  

The Right to Access. You have the right to request NICESEATS for copies of your personal data.  We may charge you a small fee for this service.

The Right to Correct. You have the right to request NICESEATS correct any information you believe is inaccurate.  You also have the right to request NICESEATS to complete information you believe is incomplete.  

The Right to Erasure. You have the right to request NICESEATS to erase your personal data, under certain conditions.

The Right to Restrict Processing. You have the right to request NICESEATS restrict the processing of personal data, under certain conditions.

The Right to Object to Processing. You have the right to object NICESEATS processing of your personal data, under certain conditions.

The Right to Data Portability. You have the right to request NICESEATS transfer the data we have collected to another organization, or directly to you, under certain conditions.

Children

The Site is not intended for persons under 18 years of age, or any higher minimum age in the jurisdiction where that person resides (“Child” or “Children”), and is not intentionally developed for or directed to Children. If we learn that we have collected information of a Child, we will take steps to delete such information from our files as soon as possible and, if applicable, terminate that Child’s account.

We take the security of your Personal Information seriously. Your California Privacy Rights

Exercising your CCPA Rights.  

To request (a) information about your Personally Identifiable Information collected or (b) deletion of your Personally Identifiable Information, please send an email with your request to hello@niceseats.com .  

 

We can only respond to verifiable consumer requests.  A verifiable consumer request means a request that is made by consumer, by a consumer on behalf of a consumer’s minor child, or a person registered with the California Secretary of State that is authorized to act on your behalf.  Your verifiable consumer request must include (1) sufficient information that allows us to verify your identity or provides sufficient authority to make the request; and (2) describes you request with enough detail to evaluate and respond to your request.   We will not respond to any requests if we cannot verify your identity or authority to make the request and confirm that the personal information belongs to you.  You are not required to create an account in order to make a verifiable consumer request.  We are not required to comply with more than two verifiable requests from the same consumer in a 12-month period of time.

 

Please allow 45 days to complete your request.  We will inform you if more time is required to complete, but it should take no longer than 90 days.  if you have an account, we may provide our response to your account.  If you do not have an account, we will provide our response according to your requested format, namely, electronically or by mail. Please note that there is no charge for making a request, but we reserve the right to charge a fee if the request is deemed excessive, repetitive, or manifestly unfounded.  We will notify you of any fee and reasons for such fee before completing your request.  

 

Right to Opt-out of the Sale of Personal Information.

According to the Act, you have the right to opt-out of the sale of your Personally Identifiable Information.  We do not sell, share, or disseminate any Personally Identifiable Information to any third party.

 

Non-Discrimination.

We will not discriminate against you because you exercised your rights under the CCPA including: (1) denying goods or services; (2) charging different prices or rates for goods or services through discounts, benefits, or imposing penalties; (3) providing different level of quality of goods or services; or (4) suggesting that you will receive a different price, rate, quality, or level of goods or services.  

 

Please note that if you do exercise your CCPA rights, you may not be eligible to receive discounts, cash back rebates and other benefits from merchants and other service providers since they will not be able to verify your identity and/or eligibility.

The CCPA gives residents of the state of California the right to prevent businesses from selling their personal information.
