Refund and Cancellation Policy
If you are dissatisfied with your purchase, NICESEATS will refund the amount paid for your purchase. Refund requests must be made directly to NICESEATS at firstname.lastname@example.org. In the event the customer has received defective merchandise NICESEATS will replace the item requiring that photographs are emailed to email@example.com to confirm the defect. All refund requests must be made within fourteen (14) days of the date of shipment by NICESEATS.
NICESEATS is not liable for products that are damaged or lost in transit to NICESEATS. Promptly following NICESEATS’s receipt of your request (typically within thirty (30) business days), NICE SEATS will credit the amount paid for the returned product (less any shipping and handling costs/fees related to the original purchase, which are non-refundable) to the credit card you used to make the original purchase. Notwithstanding the foregoing, NICESEATS does not control when a specific credit card company processes a charge-back transaction. You are responsible for contacting your credit card company if you have questions about the status of the charge-back.
NICESEATS will not provide a refund for a request that is received by NICESEATS more than thirty (30) days after the date of original shipment. NICESEATS also does not provide a refund for returned products that are damaged due to misuse, lack of care, mishandling, accident, abuse or other abnormal use. Shipping and Product Acceptance
All shipments are sent first-class mail via the US Postal Service. The risk of loss and title for all products purchased via the web site pass to the customer upon delivery of the item to the carrier.
Choice of Law
These conditions shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under these Conditions shall be resolved exclusively by the state and/or federal courts of the State of California, County of Los Angeles and/or the Central District of California.
IN NO EVENT SHALL NICESEATS BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES THAT RESULT FROM (A) THE USE OF, OR INABILITY TO USE, THE SITE; (B) THE PERFORMANCE OF THE SERVICES, PRODUCTS AND MATERIALS AVAILABLE FROM THE SITE; OR (C) THE CONDUCT OF OTHER USERS OF THE SITE, EVEN IF NICESEATS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE. YOUR ONLY REMEDY AGAINST NICESEATS FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE. THAT SAID, IF NICESEATS IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH IS IN ANY WAY CONNECTED WITH YOUR USE OF THE SITE OR ANY CONTENT, NICESEATS’ LIABILITY SHALL NOT EXCEED US$ 24.00. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF SOME TYPES OF DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU
